These is how the two ratings, M and AO, are described per esrb.org:
M Rating is 17+
"Content is generally suitable for ages 17 and up. May contain intense violence, blood and gore, sexual content and/or strong language."
AO Rating is 18+
"Content suitable for adults ages 18 and up. May include prolonged scenes of intense violence, graphic sexual content and/or gambling with real currency.
The degree to which sexual content is used in a game is what separates a M from a AO rating in this case.
So if porn was added to the game the rating would change to AO for obvious reasons.
It's not CDPR responsibility, however, if something bad happens like a parent getting arrested or a company gets sued for selling the game accidently/intentionally to a minor the company who made the game will suffer blowback for it whether they deserve it or not and when they do a risk assessment of making a AO game of that kind it's usually just not worth it.
i think sexual thing is over, we had our fun with Witcher 2 and 3, its going down from here. I'm talking about AAA games. Even Witcher 4 will have less sex scenes than CP2077. Because big companies dont do that. Sexual gaming will start thriving from indie games until one of the indies make it and become viral.

Looked at objectively it doesn't make a lot of sense but the reason for this is, like I said, one is regulated by law and the other isn't. Though there has been some push in the United States at least to make is so any games with any amount violence or sexual content are illegal to be bought/played by minors. So M rated would become 18+ basically. But they haven't been very successful thus far.
This is mostly self regulated by the media industry. Laws don't really touch on this to much in the United States at least.

Not pitchforks, handcuffs. The former is only really regulated by the media industry while the latter is regulated by laws. Most gamers I would wager don't care if there are titties, as you put it, or not all that much but the law really does care who is seeing them.
The problem with this is that if CDPR where to add BDs that where considered "porn" no one under the age of 18 (in the United States at least) would be able to touch this game, doesn't even matter if they never use the BDs, with out fear of getting in legal trouble or getting whoever gave them the game in legal trouble. Even a remote chance of a minor playing the game if it had this kind of content in it is why CDPR will never add porn BDs to CP. Now it is possible, as said in previous posts in this thread, for CDPR to add erotic BDs that don't cross the line into porn but it is a very fine line so I doubt they will risk it. Besides modders will do it eventually so don't worry you will have your porn BDs at some point in the future.

I am aware that there are laws for one thing and not for the other. A few huge countries ( big gaming markets ) have different laws for various things.
Though while for some markets the products get adjusted for said market, it seems the same wont be done for other huge markets.
If, as you point out, in the United States the nudity is heavy regulated by law then there would also be the option to cut that content from the game for that particular market but leave it available for the rest. As is done for various things for any big market ( country ).
Dont get me wrong though, i am not advocating on behalf of more nudity content. I am advocating for freedom of choice.

I'm "yes"- whether you want to watch it or not is another questions. Let's make this game adult as it's supposed to be. Game was advertised as having strip clubs, prostitutes and so on. Hell, it should have drugs as well. We're taking dystopian here. And still you can't officially take off your pants. So much for being adult. It's not about needing to have all this stuff- it's about being true.

To be fair you can still see titties in the game (if you turn nudity on). Female nudity is more "acceptable" than male nudity. In the first mission where you save Sandra, you can see her completely bare but not the dude who was next to her because oh my god manbutt! Naked men are nowhere in the game. Meanwhile you can see Alt completely bare as well.

Look I understand people WANT BD porn, no problem with the concept myself, but it's ridiculous IMO to think that effectively you want CDPR to become a porn production company.
I don't think anything should be left out! this is their art, their showcase and should be presented the way it was intended.
Braindances are shared experiences, and obviously the game deals with not only porn, but some pretty dark and even horrific experiences that people monetize.
You do see some pretty messed up braindances in the game, and others which are much worse are referenced.
It's an interesting subject to explore, as virtual experiences become more immersive what types of experiences will be available, and what will the cost of those experiences be for example the human cost in being able to experience a crime in a braindance.
I think that's an awesome subject to go into, and the medium should serve the exploration. But having porn for porn sake is a waste of time.
