Somebody claimed ownership in the Content ID system. It was clearly the developer/publisher in many cases, as they're the ones coming up in the takedowns. That doesn't mean they wanted this to happen. The content owner pretty much HAS to register their content, otherwise the first person who takes their content and re-uploads it can register it, and that can lead to the publisher and everyone else getting full-blown takedown notices. I saw that happening with a music composer (mentioned earlier in this thread) and it was an even worse nightmare for everyone concerned.

The problem is the change of meaning of some flag setting. When the owner registers it, they can say what they want to happen if someone else uploads. This can be anything from "Nothing, I don't care" thru "OK, but don't let them monetarise" to "Take it down". Whatever flag the developers/publishers used is now being interpreted differently by Google.

There's plenty. Vimeo for example.

Vimeo unfortuately has guidelines that would prevent you from uploading gameplay walkthroughs or trailers since the content they feature lean towards videographers or actual video or content creators since you can only upload videos of content that you, the author of said video, also created and not for example upload a video you made playing through a game unless you, the author, was also the developer of said game as well. If for example, it was a machinima-type or a Source filmmaker type of video wherein its more of taking advantage of a game engine to create a video with a story for example than that's fine.

Here's a quote I got from their guidelines:

"Upload only videos you created yourself.

You must own or hold all necessary rights (copyrights, etc.) to your video.
“So-and-so gave me permission” does not mean you created it.
You can upload videos that you appear in or helped create (as director, DP, editor, musician, motion graphics artist, actor, etc.) as long as you have the necessary permissions from the copyright holders.
Please add your role in the video description to avoid deletion.
Exception! Vimeo PRO members can upload videos they did not create as long as they hold the necessary rights and permissions.
You cannot upload certain types of content:

No rips of movies, music, television, or any other third party copyrighted material. Read more about copyright and fair use.
No sexually explicit material or pornography. (Artistic and non-sexual nudity is allowed. Read more.)
No videos that are hateful, harass others, or include defamatory or discriminatory speech. Read more.
No videos that depict or promote unlawful acts, extreme or real-life violence, self-harm, or cruelty toward animals.

Also to be more on topic: One of Konami's own videos got flagged in their own channel, which goes to show how the Content ID system at this very moment is COMPLETELY FUCKING BROKEN. If the owner get's flagged even though they are the owners of said videos you bet your ass there is a a huge problem.

Other incidents have also been reported for the past few years with content that isn't games related (obviously since the guidelines involving games has only been implemented recently) of people uploading videos having clips or parts where it was playing royalty free music or music that is open to the public domain such as classical music being flagged or taken down automatically because a news network from a different country (usually either from Europe or from Asia) apparently "owns" the rights to the music. Dude, fucking classical music is public domain! What idiot in YouTube allowed that to be owned by an entity, let alone a news network in some other random country?

Even YouTube, issued a letter to content creators to the channels addressing the issues people have been having and from the way it was written it was just being super formal and just told people the process that most of them have probably already been going through at the time the letter was sent and didn't say anything if in regards to these changes getting better or not even issuing any sort of apology or recompense to the people who are getting screwed.

I'm not just even talking about people like Angry Joe, I'm talking about people's videos (game videos) being taken down because the music that they used was licensed and given permission by the very person who created the music but was flagged by a music distribution company who publishes them in certain countries. If the people who owns their stuff gets fucking told that they can't show it off or allow others to use it because of someone else, a company, who also bought the license from you or paid you so they can distribute your stuff, then what's the point. That's just complete and utter bullshit.

Performances, broadcasts, and arrangements of public domain music are not in the public domain. Cursing will not change that.

Youtube's system is still broken and needs to be fixed. But your belief that such music is free of royalties is mistaken.

.. or could it very well be that whoever was the Konami employee who uploaded the video failed to follow the Content ID guidelines for uploading their own videos? Unless of course Google has finally created a true AI which can determine on its own who owns what...
