Namco, you have just lost every possible purchase from me forever. I hope you get Aarded into a bed of spikes!! I know I made a word up. Maybe if every customer(or a substantial amount of customers) who bought Witcher and Witcher 2 emailed something similar to what I just said Namco will back down and leave CD Projekt alone.

Write Namco HR. Tell them to drop the suit or you'll refuse to purchase titles from that publisher. I'm not sure who would actually buy crap from them in the first place but at least it's something you as a consumer can do to support developers you like and it took me like 15 minutes total.

To a certain extent, I agree with you. This decision is basically to stop CDPR from acting as though they have already won, when the case hasn't been heard yet. It's very unfortunate, and I hope it doesn't impact on the release date, but it isn't in itself an indication that they're going to lose.

And in answer to an earlier question - yes, it's quite common for big companies to sue little companies or individuals when they've no chance of winning. Standard pressure/bullying tactics. Just look at all of the copyright cases that get thrown out of court when they eventually go to trial.

i will do that. not sure what "great" games namco makes. however screw Tekken, it has barely changed since Tekken 3 on the playstation

If the contract required the game to include DRM, then Namco Bandai may have their way with it. But I don't think that extends to forcing DRM on existing copies that have DRM removed; that's barring the barn door after the horses have run out. Money damages are the usual remedy for breach of contract, anyway, and NB will have to establish how much damage they have suffered (which is, arguably, none at all).

Anyway, the DRM issue is to be settled later (27 September). In the same court where CDP already got homered

What are they suing them for, money?

Maybe they should just let Namco publish the game, although THQ can do a better job I'm sure.

Yeah I dont get it either, what has CDPR really got to loose apart from a distributor? As long as the 360 owners get their game does it really matter?

Please excuss my igorance! I'll just go and sit in a corner :'o(

Yeah... can any law-savy types here give us a summary?

I get the who is sueing who and why thing, but still a bit confused. What is CDPR's argument? What are the two sides hoping to get out of it? What is the impact to existing witchers players, and potential 360 customers?

If 'CDPR' loses completely, what's the 'loss'/consequence?

Let's just hope CDPR won't take a too serious blow if their second meeting on court with Namco BANDAI goes similarly... :/

I have no idea what is at stake here.

The real reasons are obscure to every of us, but I'v an idea: CDPR could have not appreciate the conditions imposed by the company (especially regarding the platform issue). About DRM, either they screwed everything with those registration troubles we had after 17th May, or Namco pretended them to apply more forceful DRM (while CDPR always stated that DRM would be "softer" to reduce the risk of customers at a minimum). Just speculation...

If I recall correctly Nameco Bandai (NB) is withholding retail sale monies until the case is resolved. Now that also means monies they currently retain in their coffers is making them money with interest.

Truely lame.

Well, I guess as they say, even bad publicity is better than none at all and that doesn't cost a thing. ;)

I have to agree with Reod on this...things are very early yet and no one has won or lost the case as of today.

From the Gamespot coverage it appears to me that the real bone of contention by Namco with CDPR is the GOG version of the game, since Namco was under the assumption that it had 100% of the Witcher2 PC distribution rights in the EU. Namco seems to be saying that GOG usurped its distribution rights, and had no right to either sell the game in Europe or to consequently remove the DRM within the game. CDPR will be reluctant to say anything as to whether it is "winning" or "losing" because the case is currently in the courts and the company *can't* say anything about its progress. Based on the CDPR quote as related by arthursmbg.com above, I'd say CDPR has everything well in hand.

Non-legal people, when reporting on the status of a civil case, frequently misunderstand what is going on and are quick to jump to unwarranted conclusions. The fat lady, contrary to popular opinion, has yet to sing...;)
