I think if he wanted it to come across as a general criticism, it should have been left out of the "A Broken Promise" video. The way it was presented made it seem like it was to be taken as supporting evidence of a "next gen open world" unfulfilled promise. His takes are always a bit more on the comedic side, so take that into account. It's still a very good compilation video that roasts the issues the game has.
Wasn't that a general criticism that the city is empty and devoid of any meaningful activities? Anyway, THIS particular video is a lot less "LULz" than BeatEmUp's, and mentions plenty of cases where the marketing suggests one thing but the game delivers something else.
And, again, I wouldn't feel comfortable suing CDPR over false advertisements, but the marketing is defensible purely on a "technical" basis. Like "branching narratives" ends up being a choice given to the player to pick the final mission or that one mission related to getting the Flathead...
I agree that there is not much legal ground to stand on over false advertisements.
