It's very unlikely that it will be on GOG or anywhere else DRM-free anytime soon. It's a AAA game from 2009, which is fairly recent for GOG standards. In fact, my major gripe with both Batman Arkham games is they are filled to the brim with DRM. Never had any technical issues but the whole activation + online patches + CD check is incredibly annoying.
The games themselves are truly excellent. It is a shame some people will probably never play them.

I love them both! You are also forgetting the first 2 X-Men movies. I should have been more clearer when I said 'today's gen', I actually wanted to mean in the recent years, poor choice of words I guess (well we have X-Men First Class too)
Coming to topic, there is a lot of potential for superhero games, but it has to be done right!
I guess X-Men has potential, but really any game that's not just about shooting or punching is much more challenging to make, so especially for a 'video game based on...' a total fuckup is very likely. Translating those cool magic-mutant-superpowers into interesting gameplay is quite difficult.

Yeah they have some newer games, but only indies. And The Witcher. And some Kickstarter cRPG's.
But I highly doubt anything major released within the last 6 or so years would ever show up there. Especially when such a large media company (Warner Bros) is behind it.
EDIT: OK yes, that's true. WB took over the publishing of TW2 EE and it is on GOG as well. But maybe it has something to do with CDPR owning the franchise.
I imagine anything Batman related is so corporate that it would take heaps of paperwork to release DRM free, even if noone is buying it anymore.
Oh and might I add, Arkham Asylum originally shipped with online activation, GfWL, CD-check, AND Securom. Back when I bought it I was unaware of the existance of both GfWL and Securom.
Yes, I noticed that GOG doesn't ship many recent games (like new Tomb Raider series and etc.). But it's not because GOG ignores them as new. The only forms strong enough to contain their nightmare essences in this universe would be that of superhumans, and so they invade the dreams and imaginings of scientists and philosophers with the aim of creating host bodies for themselves.

Geez... hard question! Batman is the only marvel\DC hero I can stand with, I can't really understand the infinite superhero philosophy.
The only ones I like slightly most are X-Men (for the alienation\discrimination\being considered monsters-theme) and movie version of Iron Man. If they made a videogame with Robert Downey Jr-Tony Stark, or the X-Men I would probably be interested. But they should built a strong believable story and atmosphere, similar to Arkham games. which I seriously doubt. I mean: Batman games come after Batman movies and TAS, which are great by themselves, thanks to Tim Burton and Bruce Teem works. And the credits for AA original idea go to Dave McKean Batman Arkham Asylum graphic novel (if you don't know it, I recommend to read it, it's unique!). And (god forgive me for this!) even Schumacher's given his contribution (at least in some elements, the "don't"s probably LOL).... since I cannot remember any specifical remarkable movies regarding the rest of the superheroes, I am afraid we only may have other Green Lantern-like videogames.
Speaking of which: I remember when I saw last Nolan's Batman 3 I jumped on the armchair saying that it's too much similar to AC story! wtf!!! LOL
Regarding villains: well maybe it's better to talk of "anti-heroes", but A. Moore's Watchmen may serve the cause. I guess Moore would kill me for this, but....

Speaking of Downey Jr, probably they could make some sort of steampunk-victorian game featuring Sherlock Holmes, maybe similar to L.A. Noir but with more action (hey devs... if you ever want to use this idea, please contact me in private!)

Yes, it is one of my favorite graphic novels! I especially love Dave McKean's art style, and the narrative approach by Grant Morrison is also unique for this kind of work.

Yeah, I also considered Watchmen but since the context and team are more relevant than individuals, I have a hard time imagining how it would adapt to a video game. A Watchmen-inspired game, however, would be interesting. One where you build your vigilante in a similarly paranoid time period.

Oooor, a Jack the Ripper game in Steampunk Victorian London! I suppose we would play the side of the police, unless the devs want to be truly unique and let us play a serial killer /> That'd probably be controversial.
Oooor... another good idea could be make a game base on Miller's Sin City, where you play the cop.
I like the Jack the Ripper idea. If they could give to the game the same taste of Moore's To Hell..... gawsh he will kill me sooner or later I suspect!
That's sad. My distaste to DRM won't let me tolerate such a thing I could go out of my way buying it and then getting some version with broken DRM just to get normal user experience, but that would feel like supporting those who pushed such crazy DRM on users nevertheless.
